Association Election Checklist: Backward Planning, Eligibility, Ballots and Counting Across the Three Chapters
A dated backward-planning election checklist for condominiums, HOAs and cooperatives, marking each step for the chapter that requires it, from day 60 to retention.
Elections are lost on the calendar more often than at the ballot box. Chapters 718 and 719 impose a fixed 60-day sequence that cannot be shortened; Chapter 720 imposes almost nothing and hands the job to your governing documents. This checklist runs the sequence backward from the annual meeting date and marks each item for the chapter that requires it.
Download the PDFThe PDF is a designed, printable copy for the board packet, the bulletin board or your meeting portfolio. On screen, you can tick the boxes below; nothing you tick is saved or sent anywhere.
Work it backward. Put the annual meeting date on the calendar first, then count back 60, 40, 35 and 34 days and put those four dates on the calendar too. Everything else hangs off them.
Items marked [Condo/Co-op] come from Chapters 718 and 719, which run the same statutory sequence. Items marked [HOA] come from Chapter 720, which does not. If you are running a condominium election, use the fuller condominium election checklist instead of this one.
The backward-planning sequence
§ 718.112(2)(d)5.a.
It may go by separate mailing or be included in another association mailing, including a regularly published newsletter. Sixty days is a floor, not a target; build in slack for a printer delay.§ 718.112(2)(d)5.a.; § 719.106(1)(d)1.a.
A candidate must be eligible to serve at the time of this deadline, not at the election. Someone who cures a delinquency on day 39 is still off the ballot.§ 718.112(2)(d)3. and (2)(d)5.a.; § 719.106(1)(d)1.a.
The association pays the mailing, delivery, transmission and copying costs, is not liable for the contents, and may print them on both sides to save money.§ 718.112(2)(d)5.a.; § 719.106(1)(d)1.a.
Not less than 14 days and not more than 34 days before the election. Sending it on day 35 is as defective as sending it on day 13.§ 718.112(2)(d)5.a.; § 719.106(1)(d)1.a.
Chapter 720 supplies no 60-day or 40-day step. HOA elections are conducted in accordance with the procedures in the governing documents, so your own documents may impose a longer sequence than the statute.§ 720.306(5); § 720.306(9)(a)
Candidate eligibility screening
[Condo] A person is delinquent if payment is not made by the due date specifically identified in the declaration, bylaws or articles; if none is identified, the due date is the first day of the assessment period. [HOA] A director who becomes more than 90 days delinquent is deemed to have abandoned the seat.§ 718.112(2)(d)3.; § 719.106(1)(d); § 720.306(9)(b)
[Condo] If it later turns out a director was ineligible because of a felony, the validity of board action already taken is not affected.§ 718.112(2)(d)3.; § 719.106(1)(d); § 720.306(9)(b)
§ 718.112(2)(d)3.; § 719.106(1)(d)
Only board service on or after July 1, 2018 counts toward the limit.§ 718.112(2)(d)3.
§ 718.112(2)(d)3.
Disqualifying a candidate is the decision most likely to draw a challenge. Decide it with counsel, in writing, and keep the file. See our note on candidate eligibility.

Envelope handling
The envelope machinery is not in the statute. It is in the Division rule, which is where a manager should look for the operative language.Fla. Admin. Code R. 61B-23.0021
This is the one place Chapter 720 does supply election machinery, and it applies only if the documents permit absentee secret balloting in the first place.§ 720.306(8)(b)
Pre-verification of the information on the outside of the outer envelope is permitted at a properly noticed open meeting. Opening it is not.

The impartial committee
This is the rule people break by asking the outgoing president's spouse to help count. It taints the count and gives a losing candidate something real to argue.Fla. Admin. Code R. 61B-23.0021

Seating, turnover and retention
Five days, not five business days, and it applies to committee members too. Send the written reminder the day after the election. See our note on the post-election transition.§ 718.111(12)(f)
[Condo] Both the certification and a 4-hour course certificate, submitted within 1 year before or 90 days after election or appointment, with 1 hour of continuing education annually after that. [Co-op] Either the certification or the course. [HOA] The statute prescribes subject matter but no written-certification alternative and no initial hour count in the text.§ 718.112(2)(d)5.b.; § 719.106(1)(d)1.b.; § 720.3033(1)
